What is a Kyrgyz apostille?

Kyrgyz apostille is a stamp whose form, content, and purpose are defined by the Apostille Convention of 1961. The “Apostille” stamp must be in the form of a square cliché, measuring 12×12 cm, with the heading “Apostille”. That is, an apostille in Kyrgyzstan is a stamp of the international apostille standard defined in the Hague Convention.
Apostille of the Hague Convention (including the Kyrgyz Republic) – is a unique seal that confirms the authenticity of the signature, the status of the person who affixed the signature on the document, and, if necessary, also confirms the genuineness of the seal or stamp used to execute this document.
The procedure “Apostille” – is the process of affixing the “Apostille” stamp on official documents issued in the Kyrgyz Republic, for their further use in the territory of the countries-parties to the Hague Convention.
The Apostille in Kyrgyzstan contains information only in the state language – Kyrgyz (Kyrgyz). The heading of the Apostille is written in French – Apostille.

Kyrgyzstan acceded to the Hague Convention on Apostille on November 15, 2010. The Apostille became effective on July 31, 2011. This means that documents issued before July 31, 2011 cannot be apostilled. Such documents must be reissued as new-style documents.
Kyrgyzstan does not have a valid Hague Convention with some member states, such as Austria, Belgium, Germany, and Greece.
This means that for these European Union countries, the procedure of consular legalization will apply.

Why is an apostille needed if documents from Kyrgyzstan already have a seal and official’s signature?
The fact is that many officials work in ministries and departments, state bodies, archives, and registry offices of Kyrgyzstan.
Officials change periodically. That means there are many signatures and they also change. To ensure the originality and authenticity of a document and avoid forgeries, it is necessary to check whether the official’s signature matches the samples of his signature. And whether it was he who signed this document.
On the scale of such a large number of documents and such a large number of officials, doing this is very difficult. This is especially many times more difficult for those officials who accept your documents abroad.
Therefore, a system for verifying all signatures and seals by several persons was established – to facilitate the work of foreign officials. This also reduces the time for reviewing documents abroad, as well as the waiting time for applicants. In such a system, it is easier for local officials responsible for Apostille to check signatures, seals, and the documents themselves (their forms and content).
Workers who have access to the internal database of signatures, stamps, and document samples also enter a special registry with their signatures. However, this registry is limited to a dozen signatures, the samples of which are transferred to other partner countries or are easily verified by them through other means.
There are two procedures of such confirmation. The first procedure – the most reliable – is document legalization. When documents are signed by the issuing official, then the document is certified by a ministry employee (usually the Ministry of Foreign Affairs), then the last signature is verified and certified by the consulate of the country where the documents need to be provided. Verification is carried out based on an up-to-date database (list) of signatures – through a chain of three departments (institutions, state bodies).
Second procedure is based on a higher level of trust and bypasses one department, usually the Ministry of Foreign Affairs. In this case, we are talking about an apostille. An apostille is a special stamp of a prescribed form that greatly simplifies the procedure for recognizing documents of one state on the territory of another.
It should be noted that the practice of affixing a wet stamp with the seal of the Ministry of Justice is absent in many European countries. Often, just an Apostille stamp and the signature of the verifying official are sufficient. And in Europe, Apostille stamps are usually affixed in two languages: the state language and English.
Can Kyrgyz apostilles be verified online?
Unfortunately, it is currently impossible to check Kyrgyz apostilles online.
Is it possible to get an apostille at the Consulate of the Kyrgyz Republic?
According to the Hague Apostille Convention, the stamp An apostille cannot be obtained for Kyrgyz documents at the Kyrgyz consulate. This does not depend on the country where the consulate is located, whether it is Ukraine, Italy, Romania, and so on.
How to check an apostille on Kyrgyz documents?
The apostille is verified by the apostille number and date of issue (the apostille has a 15-digit unique number (in the row under number 8) and a date of issue (in the row under number 6)). What documents can be apostilled?
Official documents issued in the Kyrgyz Republic and intended for use in other states may be apostilled. This applies to documents issued by state authorities, notarized documents, and documents with official markings, such as registration marks, visas, or signature authentication.
Originals of official documents (including civil status documents) issued during the time of the Kirghiz Soviet Socialist Republic and the former republics of the Union of Soviet Socialist Republics cannot be apostilled on the territory of the Kyrgyz Republic.
However, on copies of documents issued in Kyrgyzstan during Soviet times, notarized on the territory of the Kyrgyz Republic, an apostille can be affixed. Otherwise, you need to obtain new-style documents and affix the Apostille stamp on them.Apostille does not apply to documents issued by embassies or consular institutions of the Kyrgyz Republic, as well as to documents related to commercial or customs operations. However, there are exceptions for some documents, such as constituent documents, patent documentation, and documents issued by state authorities, for example, registration certificates or licenses.
Documents that are prohibited from being taken or sent abroad, such as military IDs, identity cards, or passports, are also not subject to apostille.
Official documents issued by other states cannot be apostilled in the territory of the Kyrgyz Republic.
