Obtaining (Receiving) Documents
Obtaining documents requires the personal presence of the person who is the owner of the requested documents or their representative under a power of attorney. Such a power of attorney must be properly legally executed. Otherwise, state authorities have the right to refuse the receipt or apostille, consular legalisation of documents. However, in some countries, for example, Uzbekistan, a strict rule was recently introduced: a birth certificate can only be obtained by its holder – that is, the legal direct owner of the certificate and the personal data contained in it.
Which documents need to be replaced with new ones?
Old-style documents (from the Soviet Union and their early versions from already independent countries) are no longer accepted in many countries. These documents include: a Soviet-style passport (and such still exist, for example, among many pensioners from Transnistria), a birth certificate, a marriage certificate, a divorce certificate, a death certificate. The reason is the impossibility of verifying the signature of the official who signed a particular document. These officials have long since stopped working, and the Soviet Union no longer exists. Furthermore, the security features of old documents become outdated, and new-style documents are issued. In such cases, by relevant law, regulation, or decision, these documents have limited circulation within the country.
Can I order documents without traveling to the country?
Due to various reasons, many people, while living or permanently residing abroad, cannot personally travel to obtain civil status documents or various certificates (for example, a certificate of no criminal record).
Self-obtaining of documents can cause many inconveniences:
– Queues– Lack of knowledge of the language in which the documents are drawn up
– Lack of understanding of the process of correct drafting and the procedure for document processing
Obtaining documents independently (not through a legal agency) may result in:
– Errors in documents that are then difficult or impossible to correct
– Obtaining documents with incomplete data
– Preparation of an incorrect set of documents
– Missing necessary procedures and confirmations
– Incorrect procedure for document recognition, for example, using an apostille instead of consular legalisation when the apostille is not accepted (example: Germany does not recognize the apostille of Moldova and vice versa).
