The person who entrusts another is called the principal. The person who is entrusted is called the agent or authorized representative. Both persons must be adults and legally competent, and also have a valid identity document (passport, ID).<\/pre>\n\n\n<h2 class=\"wp-block-heading\">Why are powers of attorney made?<\/h2>\n\n\n\n\n\n<p>Powers of attorney are made for various purposes. As a rule, this is related to the disposal or management of funds or valuable items, as well as access to personal information and processing of personal data (documents \/ acts \/ certificates \/ references \/ extracts &#8211; from state authorities: submission, receipt, correction, re-registration).<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-\u043a\u0430\u043a-\u043e\u0444\u043e\u0440\u043c\u043b\u044f\u0435\u0442\u0441\u044f-\u0434\u043e\u0432\u0435\u0440\u0435\u043d\u043d\u043e\u0441\u0442\u044c\">How is a power of attorney issued?<\/h2>\n\n\n\n<p>In most cases, a power of attorney is issued in writing in the presence of a person authorized to confirm the identity of the principal and their will expressed in the power of attorney.<\/p>\n\n\n\n<p>As a rule, powers of attorney are signed by both the principal and an official or authorized person. For example, a notary or a consul. It may also be an authorized managing employee of a local government body. For instance, such a practice is widespread in Portugal.<\/p>\n\n\n<p>A power of attorney must include: the principal&#8217;s signature with their details, the actions delegated to the agent on their behalf, the data from their passports or IDs, the date, the certifying signature of an official, notary, or consul, as well as the corresponding seal.<\/p>\n\n\n\n<p>In most countries of the world, a power of attorney is drawn up on A4 paper using printed text. In some countries, security paper is used, for example, in Ukraine. In others, plain paper is used, for example, in Moldova.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is a notarized power of attorney?<\/h2>\n\n\n<p>A notarised power of attorney is a form of power of attorney subject to specific rules and the legislation of the country where the notary operates. All notaries are governed by law, so requirements may vary from country to country. In some countries, these requirements are stricter (for example, copies of the representatives&#8217; passports and their full details must be provided, and the power of attorney must be in the language of the notary&#8217;s country \u2013 Russia), while in others they are much more lenient (it is sufficient to provide the representative&#8217;s personal\/individual number without supporting documents, and the power of attorney may be in any language; the notary merely certifies the principal&#8217;s signature on it).<\/p>\n\n\n\n<p>The notary is obliged to indicate the principal&#8217;s details from their passport or ID. A notarised power of attorney is certified by the notary&#8217;s signature and seal. The power of attorney must include the date and place of its signing.<\/p>\n\n\n\n<p>In case of a long wait, it is often simpler to have a power of attorney drawn up by a notary (in apostille countries \u2013 with an Apostille, in non-apostille countries \u2013 with legalisation, if this power of attorney is to be sent abroad).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is a consular power of attorney (power of attorney from a consulate)?<\/h2>\n\n\n\n<p>A consular power of attorney is an authority granted by the principal, set out in printed form on paper, with the signature and seal of a consular officer.<\/p>\n\n\n\n<p>The power of attorney is drawn up in accordance with the requirements of the consulate&#8217;s country. An appointment is usually required. In case of a long wait, it is often simpler to have a power of attorney drawn up by a notary (in apostille countries \u2013 with an Apostille, in non-apostille countries \u2013 with legalisation, if this power of attorney is to be sent abroad).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Are powers of attorney made at embassies?<\/h2>\n\n\n\n<p>Embassies generally do not handle matters related to drafting and writing powers of attorney. Their competence is above this. They represent the country in official relations with another country at a high level.<\/p>\n\n\n\n<p>This function is performed by consular officers.<\/p>\n\n\n<h2 class=\"wp-block-heading\">What is the difference between a notarized power of attorney and a consular power of attorney?<\/h2>\n\n\n\n<p><strong>A notarized power of attorney<\/strong> can be presented both domestically and in other countries. In countries that have signed agreements with each other on the simplified circulation of documents, notarized powers of attorney from these countries circulate freely without additional certifications.<\/p>\n\n\n\n<p>If the countries have not signed such an agreement, then either an apostille or consular legalisation (supralegalisation or superlegalisation) will be required. Countries that have signed the Hague Convention on Apostilles use an apostille. If at least one of the countries has not signed the Hague Convention, then the legalisation procedure is applied.<\/p>\n\n\n\n<p>A consular power of attorney can only be presented in the country to which the consulate belongs or in a country with which an agreement on the free circulation of documents has been concluded. However, in all other countries such a power of attorney will be useless. An apostille cannot be affixed to a consular power of attorney, nor can it be legalised at another consulate.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Can and should an apostille be affixed to a notarized power of attorney?<\/h2>\n\n\n\n<p>As mentioned above, an apostille can be affixed to a notarized power of attorney. In some countries, notaries themselves do this, for example, in Israel. In other countries, this is done by the Ministry of Justice.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Is consular legalisation (superlegalisation) required for a notarized power of attorney?<\/h2>\n\n\n\n<p>Before submitting a power of attorney to the consulate, it is certified at a ministry (in some countries, this is the Ministry of Foreign Affairs; in other cases, the Ministry of Justice; often at both ministries).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Can and should a consular power of attorney be apostilled?<\/h2>\n\n\n\n<p>A consular power of attorney cannot be apostilled. The signatures of consular officials are not certified by an apostille.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Can and should a consular power of attorney be legalised?<\/h2>\n\n\n<p>A consular power of attorney also cannot be legalised.
